Yes, I Introduced this Bill

S909 was introduced in the Senate on April 28, 2009 by Senator Kennedy and has 41 co-sponsors. In reading this Bill, the language is such that it could be used against ordinary citizens in order to criminalize their opinions or views. As this Bill is called “Matthew Shepard Hate Crimes Prevention Act” it’s so called intent was to address hate crimes based on actual or perceived race, color, religion, national origin, gender, sexual orientation, gender identity, or disability of the victim. It is the word “perceived” that is troublesome. Just because someone thinks you “hate” him or her based on speech, you’re liable to prosecution under this law. What about the 1st Amendment? Are we not allowed to have opinions or differing points of view anymore? What is happening to our democracy when our Elected Representative appear to be working to suppress the citizenry with taxation, quelling free speech and the constant, incessant assault on the 2nd Amendment? Who’s best interest are these people looking after? Each passing day when I find more and more encroachment on the Constitution and the Bill of Rights, I am really beginning to wonder………Hmmmmm

My Letter To My Reps:

It is the word “perceived” that is troublesome. Just because someone thinks you “hate” him or her based on speech, you’re liable to prosecution under this law. What about the 1st Amendment? Are we not allowed to have opinions or differing points of view anymore? What is happening to our democracy when our Elected Representative appear to be working to suppress the citizenry with taxation, quelling free speech and the constant, incessant assault on the 2nd Amendment? If I am not mistaken, upon taking office, you took and oath to “preserve and protect the Constitution of the United States”. Your actions and voting seem to be flying in the face of that oath as you are listed as a “co-sponsor” on this Bill, and I am disappointed in your apparent approval and “rubber-stamping” this Bill. As vile and unacceptable hate crimes are, there are current laws now that covers this and no new legislation is needed in my opinion. I urge you to give this Bill a down vote as its language is flawed and can be used to violate the 1st Amendment Rights of the citizens of this nation. As always, we voter are watching your voting record on this and other issues and will use it when we go to the polls next election cycle.
